1. Agreement to terms
By downloading, installing, or using the Testament application ("the App"), you agree to these terms of service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and [TODO: YOUR FULL NAME] ("we", "us", "the Developer"), an individual based in Thailand.
2. Description of service
Testament is a document encryption application that:
- Encrypts files on your device using identity-based key derivation
- Uploads encrypted files to your own Google Drive account
- Provides tools for sharing encrypted files with designated recipients
- Provides decryption tools for recipients who possess the correct identity factors
Testament is not a legal service, not a will-creation tool, and not a substitute for professional estate planning advice. It is a secure document delivery mechanism.
3. Account and authentication
To use Testament, you sign in with a Google account. You are responsible for maintaining the security of your Google account. We authenticate through Google's OAuth2 system and do not store your Google password.
You must provide accurate information when creating or joining an organization (Business plan). You may not impersonate another person or entity.
4. Subscription plans and payment
Free plan
The Free plan includes limited features at no cost. We may adjust Free plan limits at any time, but we will not reduce limits below what existing Free users are currently using.
Pro plan
The Pro plan is a paid subscription billed monthly ($2.99/month) or annually ($29.99/year) to your individual account. Pricing may vary by region.
Business plan
The Business plan is a seat-based subscription billed per team member. The organization admin is responsible for payment. Pricing tiers:

Payment processing
Payments are processed by Apple (App Store), Google (Play Store), or Stripe (web/desktop), depending on your platform. Each payment processor's own terms apply. We do not directly handle credit card or banking information.
Free trials
Pro plans include a 7-day free trial. Business plans include a 14-day free trial. You may cancel during the trial period without being charged. If you do not cancel, your subscription begins automatically at the end of the trial.
Cancellation and refunds
You may cancel your subscription at any time through the App Store, Google Play, or Stripe customer portal. Your paid features remain active until the end of the current billing period. Refund policies are determined by the respective payment platform (Apple, Google, or Stripe).
Decryption is always free
5. Your responsibilities
You are solely responsible for:
- The accuracy of the identity information you enter during encryption
- Ensuring the correct recipient is designated for each document
- Securely delivering the secret phrase (if used) through a separate channel
- Informing the recipient that a sealed document exists and how to access it
- Maintaining the security of your Google account (we recommend enabling 2FA)
- Keeping a backup of important encrypted files (download the .testament file)
- Complying with all applicable laws regarding the documents you encrypt
6. Organization responsibilities (Business plan)
If you are an organization admin, you are additionally responsible for:
- Managing team members and their access to the shared vault
- Ensuring only authorized personnel have seats in your organization
- Removing departing employees promptly
- Maintaining your subscription payments to keep your team's access active
- Complying with data protection laws applicable to your firm's client data
If the admin cancels the subscription or fails to pay, all organization members revert to the Free plan. Encrypted documents remain in Google Drive and are not affected.
7. Prohibited uses
You may not use Testament to:
- Encrypt or distribute content that is illegal in your jurisdiction
- Conceal evidence of criminal activity
- Circumvent legal obligations (such as court-ordered document disclosure)
- Harass, threaten, or harm any person
- Reverse-engineer, decompile, or attempt to extract the source code of the App (except as permitted by applicable law)
- Use automated systems to abuse the service, overload servers, or circumvent rate limits
- Share your subscription or organization access with unauthorized third parties
8. Intellectual property
The Testament application, its design, code, and branding are the intellectual property of the Developer. Your subscription grants you a non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
Your documents remain entirely yours. We claim no ownership or license over any content you encrypt, store, or share using Testament.
9. No access to your data
Testament uses zero-knowledge architecture. We cannot:
- Access, read, or decrypt your documents
- Recover your encryption key if you lose the identity factors
- Decrypt a document on your behalf or on behalf of any third party
- Comply with requests to produce document content (because we don't have it)
If you lose the identity factors needed to decrypt a document and no backup exists, the document is permanently inaccessible. We cannot help you recover it. This is by design.
10. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for any loss of documents, data, or access resulting from incorrect identity input, forgotten secret phrases, lost ID cards, Google account issues, or any other cause
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for the actions or omissions of third-party services (Google, Apple, Stripe, Cloudflare)
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law.
12. Third-party services
Testament relies on third-party services that have their own terms:
- Google Drive — your files are stored under Google's terms of service
- Google OAuth — authentication is subject to Google's privacy policy
- Apple App Store / Google Play — subscriptions are subject to their respective terms
- Stripe — payment processing is subject to Stripe's terms of service
- Cloudflare — our auth proxy runs on Cloudflare Workers, subject to Cloudflare's terms
We are not responsible for changes, outages, or policy updates by these third-party providers.
13. Service availability
We aim to keep Testament available at all times, but we do not guarantee uninterrupted service. The auth proxy may experience downtime for maintenance or unforeseen issues. Your encrypted files in Google Drive remain accessible through Google Drive itself, independent of Testament's availability.
We reserve the right to modify, suspend, or discontinue the App at any time. If we discontinue the App, we will provide at least 90 days' notice so you can download your encrypted files from Google Drive.
14. Termination
You may stop using Testament at any time by uninstalling the App and signing out. Your encrypted files remain in your Google Drive until you delete them.
We may suspend or terminate your access if you violate these Terms. In such cases, your encrypted files in Google Drive are not affected — we have no ability to modify or delete them.
15. Changes to these terms
We may update these Terms to reflect changes in the App, our business, or legal requirements. We will notify you of significant changes through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict of law principles.
For users outside Thailand: if mandatory local consumer protection laws in your jurisdiction grant you additional rights that cannot be waived, those rights apply in addition to these Terms.
Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation. If negotiation fails, disputes shall be submitted to the competent courts in Bangkok, Thailand — except where local law requires a different jurisdiction for consumer disputes.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
18. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of Testament. They supersede any prior agreements or understandings.
